Dear editor,

On Friday, September 29, 2023, in the Gleaner, on page 1, the headline was that:  “1,010 persons polled between August 30 and September 14, 2023, by Don Anderson” produced the following results:  

58.9% wanted the U.K. Privy Council to be replaced with the Caribbean Court of Justice;

23% wanted to retain the U.K. Privy Council;  and 

18.1% were not sure.

Fellow Jamaicans, there are dangers of having the Caribbean Court of Justice as the Final Court of Appeal:

(1)  The Judicial Code of Conduct of May 26, 2020, requires that the Judges rule in favour of homosexuality.  (See https://ccj.org/wp-content/uploads/2021/03/CCJ-Code-of-Judicial-Conduct-REV-June-30.pdf    Preamble, pages 6 and 9;  Code 5.1, page 23;  Code 5.6, page 24;  Code 5.7, page 24. )

(2)  The immunities granted to the donors of the Caribbean Court of Justice are a recipe for corruption. 

 “Article XII:  Privileges And Immunities

The Fund shall enjoy immunity from every form of legal process. Its property and assets, wheresoever located and by whomsoever held, shall be immune from all forms of seizure, attachment or execution.

 The archives of the Fund shall be inviolable.

To the extent necessary to carry out the operations provided for in this Agreement and subject to the provisions of this Agreement, all property and assets of the Fund shall be free from restrictions, regulations, controls and moratoria of any nature.”  (REVISED AGREEMENT ESTABLISHING THE CARIBBEAN COURT OF JUSTICE TRUST FUND, page 7, http://www.caribbeancourtofjustice.org/wp-content/uploads/2021/02/ccj_rev_trustfund.pdf )

Therefore if the Supreme Court of Jamaica were to refer any matter to the Caribbean Court of Justice concerning the legalization of buggery, or the redefinition of marriage to include the union of persons of the same sex, or if a same sex couple may adopt children, they would legalize all of these things.  So then, since we want Jamaica to be a God-fearing and a God-loving country, we should not want the Caribbean Court of Justice to be Jamaica’s Final Court of Appeal, for this Court would make lawful what God has from the beginning of creation declared to be unlawful.  (See Bible, Genesis 2:18, 21-24). 

 If we get the chance to vote in a referendum, please vote that Jamaica remains with the U.K. Privy Council.
