Nurses Win Case After Being Forced to Change in Front of Trans-man

Nurses in Darlington, UK, are celebrating their victory after winning a case against the National Health Service (NHS), filed for forcing them to share their changing room with a trans-identifying man for years. 

One of the employees at Darlington Memorial Hospital, Rose Henderson is a biological male who identifies as female and was permitted to use the female changing room, along with  biological females. 

Under the conditions of the ‘Transitioning in the Workplace’ policy, female nurses were instructed by their superiors that if they had an issue with getting changed in front of a man who identifies as a woman, they should find alternative changing facilities

Employment Judge Sweeney and tribunal members Denise Newey and Malcolm Brain however, have ruled that the policy enforced by County Durham and Darlington NHS Foundation Trust had “admirable and noble purpose”, but it had the effect of “violating the dignity” of the nurses. It also stated the rule created a humiliating and hostile environment.

“By not taking seriously and declining to address the Claimants’ concerns of August and September 2023 and of 04 April 2024, regarding that part of the Transition in the Workplace Policy that afforded biological males access to the female changing room, the respondent engaged in unwanted conduct related to sex and gender reassignment which had the effect of creating for the Claimants a hostile and intimidating environment.”

The Christian Legal Centre (CLC), which aided the Darlington nurses in their quest for justice, has described the win as a  “a major victory for women’s rights and workplace safety.”

CLC Chief Executive, Andrea Williams said, “This judgment exposes the extent to which the NHS hierarchy has been captured by extreme gender ideology and its willingness to sacrifice women’s safety and dignity in order to uphold it. 

“Allowing a man into a female-only space because he claims to be a woman violates human dignity, common sense, the law of the land and biblical truth.”

Meanwhile Bethany Hutchison, President of the Darlington Nursing Union, spoke to media following the ruling and expressed her satisfaction with the ruling, describing their efforts as an attempt to “defend something simple and fundamental: that women deserve safe, single-sex spaces at work.”

She also added that the Tribunal confirmed what they have said from the beginning, which is that mandating women to undress in front of men is not equality, but a violation of their dignity. 

“This judgment recognises the intolerable and degrading situations women have been placed in. No woman should ever have been told to ‘broaden her mindset’ or ‘compromise’ when raising legitimate concerns for her safety and privacy. By ruling in our favour, the Tribunal has exposed the profound injustice of a policy that placed the feelings of one man, struggling with gender confusion, above the rights and well-being of women simply trying to feel safe at work.”

This is the latest landmark judgment to be handed down on transgenderism after Britain’s Supreme Court declared that the legal definition of a woman is based on biological sex last year. That ruling stated that the use of public facilities, like changing rooms, should be based on one’s sex, not subjective feelings.
